In Virginia, when someone files for a protection order—typically in response to allegations of abuse, stalking, or domestic violence—a preliminary hearing is held. In order to decide if there is sufficient urgent risk to provide temporary protection, the judge considers the petition and any supporting documentation. After being informed of the hearing, the respondent—the alleged abuser—has the opportunity to raise a defense. A final hearing to examine a long-term order is planned after the protective order, if granted, lasts for a maximum of 15 days. This offers short-term security and prepares the ground for future legal actions.
