Drugs which are a life saving product needs to be regulated so that it does not become injurious to human life and health. Thus, it is expedient to regulate the import, manufacture, distribution and sale of drugs.
Wholesalers are a link between manufacturers of drug and health care practitioners/ Pharmacy stores whereas retailers distribute prescription drugs or devices to consumers or patients. Any person, who wants to do wholesale cum retail sale of drugs in a state, must have a drug licence in that particular state.
Below are some pointers that will help you to understand the basic process for obtaining the wholesale drug Licence from drugs department:
It is mandatory to obtain drug licence before you start any business dealing in drugs, whether it is Allopathic Drugs, Ayurvedic Medicine, Homeopathy or Unani
Licenses for the wholesale of drugs can be granted only at premises which are commercial premises. It cannot be granted on other premises independent of residence, also known as mixed land use.
Separate drug licence is required for each premises.
A person/ entity must qualify the below requirement before making a decision to go for wholesale cum Retail Sale drug licence :
Premises -The premises should be independent and easily accessible and should have adequate facilities for storage of General Drugs as well as Drugs requiring special storage conditions like cold storage and deep freezer etc. wherever applicable.The area requirement for premises are as under:
Wholesale Licence- 10 sq.m.with height of 2.75 m.
Retail Sale Licence- 10 sq.m.with height of 2.75 m.
Wholesale & Retail Licence - 15 sq.m.with height of 2.75 m.
If the premises is to be used for wholesale licence cum retail it must be at a commercial location supported with municipal taxes fee receipt, parking fee and conversion charges receipt.
Competent person-Any person can act as a competent person who is registered pharmacist with the pharmacy council of the state in which the licence is being applied.
Neither the company/firm nor any Director/Partner/Proprietor of the company/firm has ever been convicted under the Drugs and Cosmetics act 1940.
